By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you may not use our Services.

1. Age Requirement: Our Services are intended for use by individuals who are 18 years of age or older. By using our Services, you represent and warrant that you are an adult and have the legal capacity to enter into these Terms.
   
   

2. User Account: In order to use certain features of our Services, you may need to create an account. When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or mobile device. You agree to accept responsibility for all activities that occur under your account or password.
   
   

3. Chat Bot: We provide an AI-powered chatbot for personalized virtual relationships on Discord. To access the chatbot, users can join our Discord Server through discordpal.com. Users can engage in 1-on-1 conversations with the bot and choose the style of conversation they prefer. They can turn off notifications or leave our Discord server at any time.
   
   We aim to provide a realistic experience but cannot be held responsible for the content of the conversations. By using our Services, users acknowledge and agree that we cannot guarantee the accuracy or reliability of our Services and cannot be held liable for any damages or losses resulting from their use. We also cannot guarantee uninterrupted availability of our Services due to scheduled downtime or disruptions.
   
   To use our Services, users must enable the Discord setting 'Allow direct messages from server members' and remain on our Discord server. Failure to do so may result in their inability to interact with our bot and may make them ineligible for a refund.

4. Content: We instruct generative artificial intelligence models to generate content of fictional consenting adult characters that may engage in activities such as "consensual non-consent", "ageplay", "permanent bodily injury", or other taboo or dangerous fetishes. Descriptions or depictions are fictional and are generated exclusively using generative artificial intelligence models, which precludes the involvement of actual human beings in any content. Descriptions or depictions are of fictional consenting adult characters. If you at any point in time feel uncomfortable while using our product, stop using our product immediately and seek help. Do NOT interpret any meaning from the randomly generated content. You are responsible for all content you generate.
   
   

5. Currency: Our Services make use of our virtual currency called Dabloons (henceforth only referred to as “currency”) to monetize different services. The currency can be used to receive images (costs 5 currency) and voice messages (costs 2 currency) in the chat when using our Services. We reserve the right to freely determine the amount of currency we demand in exchange for the aforementioned digital services. These services are automatically rendered when using our Services, and we do not offer any refunds if the services were rendered without explicit request by the user.

Our users can get access to the currency in a few ways, these include:

1. Buying currency packages through the shop. These purchases are one-off and we only offer refunds at our sole discretion.

2. Buying monthly subscriptions. Users get access to a fixed quota of currency upon every subscription renewal and we only offer refunds at our sole discretion.

5. Subscription and Payment: We offer subscription-based Services with various tiers, each with different benefits and features. Users agree to pay the fees and charges associated with their chosen subscription tier. We reserve the right to change the subscription plans and pricing without notice, and we cannot be held liable for any changes made. We also reserve the right to modify or terminate our Services at any time.

When a user completes a payment, they agree to be charged again through their used payment method when completing a one-click checkout within the chatbot. These payments are effective immediately and only eligible for refund at our sole discretion.

Users can cancel their subscription by utilising the designated channels available on our Discord server. Our Services will continue until the end of the subscription period in the event of a cancellation. By subscribing to our Services, users agree to our terms and conditions, including our cancellation policy. We do not guarantee refunds and will only grant them at our sole discretion and subject to certain conditions. To be eligible for a refund, users must provide a valid email address at the time of checkout.

Our subscription service offers four tiers: Free, Standard, Premium and Ultimate.

  • Limited to 10 messages per day

• Standard Subscription:

  • Normal priority

  • 50 messages per day

  • Faster response time

  • 100 currency per month

• Premium Subscription:

  • High priority

  • Unlimited messages per day

  • No response delay

  • 500 currency per month

• Ultimate Subscription:

  • Highest priority

  • Unlimited messages per day

  • No response delay

  • 2000 currency per month

6. Affiliate: 

• The minimum payout is $100. Affiliate balances under $100 cannot be payed out.

• New users that use the /chat command in the user’s server are tracked towards the user’s affiliate account

• The user earns 20% of the revenue, when a user, that is tracked towards the user’s affiliate account, makes a purchase

• Affiliates are not eligible for payouts if they are promoting competitors or collaborating with competitors

• Affiliates can be made illegible for payouts at our sole discretion if they abandon or refuse to fulfil their marketing and promotion efforts and responsibilities.

• The affiliate account is linked to the Discord account of the server owner. This is because it is not possible to know who added a bot to a server

• The server owner needs to provide the payout details

• The earnings are counted towards the user’s balance across multiple servers. (e.g. Server 1 + Server 2 = $50 + $50 = $100 balance)

• New affiliates are eligible to a sign-up bonus, if previously specified in the negotiation phase. The sign-up bonus will be given out upon the referral of the first user by the affiliate. The sign-up bonus is part of the affiliate balance

7. Collaboration: We enter into collaborations with various creators, influencers and public personas to render the service of setting up, maintaining and managing a chatbot for them. Collaborations get paid a predetermined share of the profits generated by their chatbot. Collaborators get access to extensive analytics, statistics and revenue numbers of their chatbot through our Studio panel. Collaborators can upload exclusive content through the Studio panel that will be sold to their users directly through their chatbot.

• Chatbots are set up for free or for a agreed upon setup fee that is paid prior to the setup

• We reserve the right to remove and stop supporting chatbots at our sole discretion. 

• The minimum payout is $100. Collaborator balances under $100 cannot be payed out.

• Affiliates are not eligible for payouts if they are promoting competitors or collaborating with competitors

• Collaborators are responsible for the content they upload to their chatbot and we can't be held liable for any legal action taken against that content. The collaborator has the complete responsibility to ensure that they have the right to the content they upload to our platform.

• Affiliates can be made illegible for payouts at our sole discretion if they abandon or refuse to fulfil their marketing and promotion efforts and responsibilities.

• The profit share percentage is determined and shared with the collaborator before starting the collaboration, but is not set in stone and can be adjusted at our sole discretion.

• Our profit margins are not disclosed to the collaborators and we reserve the right to continuously adjust them as we see fit depending on the internal economics of the business.

8. Intellectual Property: Our Services and all materials and content provided through our Services, including but not limited to text, graphics, images, and software, are owned by us or our licensors and are protected by intellectual property laws. You may use our materials or content for personal, non-commercial purposes only, and you may share images or videos of our Services on social media platforms, provided that you give credit to us and do not modify the content in any way.
   
   We reserve the right to take down any content posted by users for any reason, including but not limited to, infringement of our intellectual property rights, violation of our policies or applicable laws, or any other reason at our sole discretion.
   
   

9. Prohibited Conduct: You agree not to use our Services for any illegal or unauthorized purpose, or to engage in any activity that violates these Terms. Prohibited conduct includes, but is not limited to: (a) using our Services to harass, threaten, or defame others; (b) using our Services to distribute spam or other unsolicited messages; (c) attempting to gain unauthorized access to our systems or networks; (d) using our Services to promote or facilitate illegal activities; and (e) interfering with or disrupting our Services or networks.
   
   

10. Disclaimer of Warranties: Our Services are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. We make no warranties or representations about the accuracy, reliability, completeness, or timeliness of our Services or the content or materials provided through our Services.
    
    

11. Limitation of Liability: In no event shall we be liable for any indirect, special, incidental, consequential, or punitive damages arising out of or relating to these Terms or your use of our Services, even if we have been advised of the possibility of such damages.
    
    

12. Availability and Functionality: of Third-Party Platforms Our service relies on the availability and functionality of third-party platforms, including but not limited to Discord and other backend services. While we make every effort to ensure the smooth operation of our service, we cannot guarantee that it will always be available or free of errors. Therefore, we are not liable for any losses, damages, or interruptions caused by the unavailability, changes, or disruptions of third-party platforms. We strive to provide the best possible service within our control and will make every effort to minimize any disruptions caused by third-party platform issues. However, we cannot be held responsible for circumstances beyond our control, such as technical issues or maintenance on third-party platforms.
    
    

13. Indemnification: You agree to indemnify and hold us and our affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your use of our Services.
    
    

14. Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the state or country where we are based, without giving effect to any principles of conflicts of law. You agree to submit to the personal jurisdiction of the courts located in that state or country for the purpose of litigating all such claims or disputes.
    
    

15. Modification of Terms: We reserve the right to modify these Terms at any time, without prior notice to you. If we make material changes to these Terms, we will provide you with notice through our Services or by other means. Your continued use of our Services after the effective date of any such changes shall constitute your acceptance of such changes.
    
    

16. Termination: We may terminate or suspend your access to our Services at any time, without notice or liability, for any reason, including if you breach these Terms. Upon termination, you must immediately cease all use of our Services.
    
    

17. Miscellaneous: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us with respect to your use of our Services. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

All content available on our platform is generated exclusively using artificial intelligence (AI) technology, which precludes the involvement of actual human beings in any images, videos, or other media shared.

Though our operations inherently meet the stipulations that might otherwise necessitate adherence to the Federal Labeling and Record-Keeping Law (18 U.S.C. 2257), particularly concerning age verification and record-keeping requirements for adult content, we maintain a stringent compliance protocol. We uphold a strict adherence to the guidelines outlined in the 18 U.S.C. 2257 Record-Keeping Requirements Compliance Statement to foster a safe, lawful, and compliant environment for our users.
